Features/ POSH Compliance NEW

PoSH Act compliance,
built with care.

Indian workplaces with 10+ employees must comply with the Prevention of Sexual Harassment Act 2013. Garuda gives you the Internal Committee, the complaint pathway, the annual training, and the statutory report — with confidentiality enforced at the database level.

The Act

Six things the law mandates.

The Sexual Harassment of Women at Workplace (Prevention, Prohibition & Redressal) Act 2013 places six explicit obligations on every workplace with 10+ employees. Garuda covers all six.

  • §4(2)Internal Committee with a woman Presiding Officer + woman external member
  • §9Mechanism for any aggrieved woman to file a written complaint
  • §11Inquiry process within 90 days from complaint
  • §13Final inquiry report, recommended action within 10 days
  • §16Confidentiality — identity of complainant, respondent, witness held confidential
  • §21Annual report to the District Officer with case statistics
Internal Committee

Set up your IC in one screen.

Composition validator

Enforces the §4(2) shape: woman Presiding Officer, 2+ employee members, 1+ external NGO/lawyer member. Refuses to save an invalid IC.

Term tracking

Three-year terms per member. Auto-reminders 60 days before expiry. Re-nomination workflow with audit trail.

Per-branch IC

Multi-branch organisations — each branch with 10+ women employees needs its own IC. Garuda manages each one separately.

Member training tracker

IC members must be trained. Built-in training module + completion tracking + refresher every two years.

Mandatory display

Auto-generated IC poster (Form 6) and contact card for the workplace noticeboard. Multilingual: English + Hindi + state language.

Confidential mailbox

A reserved internal email + portal URL only IC members can read. Complainants can also choose paper, voice, or in-person.

Complaint workflow

From complaint to resolution.

Every step in the statutory pipeline — with the 90-day clock running visibly, and confidentiality enforced at every step.

Day 0

Complaint filed

Web, app, mailbox, voice note, or assisted entry by an IC member. Encrypted at rest.

Day 1–7

Conciliation offered

Optional, at complainant's request. Both parties sign. Settlement filed with DO if accepted.

Day 7–80

Inquiry

Hearings scheduled; witnesses summoned; written statements collected; documents exhibited. All logged.

Day 80–90

Report drafted

IC findings + recommendations. Stored as immutable PDF; signed by all members.

Day 90–100

Action & closure

Employer implements §13(3) action within 60 days. Closure noted; both parties informed.

Confidentiality, technically enforced

Names that should not be seen, aren't.

§16 of the Act mandates confidentiality. Garuda enforces it in the database, not just in policy. PoSH case records are encrypted with a separate key. Only nominated IC members can decrypt — and every decryption is logged.

  • Row-level security — HR managers, even SuperAdmins, cannot read case content without an IC token
  • Pseudonymous case numbers in management dashboards — names never appear in aggregate views
  • Audit log of every read — who opened which file when, immutable
  • No export to spreadsheet — case data is on-screen-only for IC members
  • Statutory penalty for breach — §17 fine of ₹5,000 displayed in the IC member training
